TERMS AND CONDITIONS
In Pro Auction Company we do everything possible to make our auctions transparent and fair for everyone. Please read the following information before you bid and buy.
Registration and deposits
Registration to bid is free. You may be required to place a refundable bid deposit.
Every auction is unreserved. Every item is sold to the highest bidder on auction day, with no minimum bids or reserve prices. Owners are forbidden by contract from bidding on items they are selling. Bids are irrevocable, and all sales are final. If you're the highest bidder when the time auction closes and the item has been sold, you're the new owner of that item.
Everything sells "as is, where is"
We recommend that you visit the auction site to inspect any items you'd like to buy before bidding on auction day. You may also send someone to the site to conduct the inspection on your behalf. All items are offered "AS IS, WHERE IS" announced at the time of sale with NO WARRANTIES or GUARANTEES. Notice to Buyer: the vehicles/associated equipment are sold as and where is and with all faults, Pro Auction Company makes no warranties, express or implied as to the equipment. The Buyer agrees to indemnify and hold harmless Pro Auction Company from any/all damages, injuries, and/or causes of action which may involve any equipment, vehicle, and/or associated equipment occurring subsequent to the date of this sale or such equipment, vehicle, and/or associated equipment.
Transaction fees for buyers
An administrative fee of $20.00 and $65.00 Document fee will be charged on all titled lots sold and a fee of $10.00 will be charged on all non-titled lots sold, on top of the 16% buyers fee. Fees will be charged regardless of the purchaser exemptions or residence.•
On vehicles a $58 smog test fee, $19.00 National Motor Vehicle Fee, Registration Fee, Transfer Fee, .65% License Fee and a Weight Fee.
For each titled Auction Item sold in California, Purchasers who are California residents will be charged California sales tax and applicable fees at the time of purchase.
Non Resident CA buyers will be charged California sales tax, but will be eligible for a refund of such sales tax after presenting Auctioneer with a signed bill of lading. This means your purchase must be transported by a common carrier with a bill of lading. The common carrier must have valid DOT and ICC/MC numbers and not be owned by the buyer.
All California Retail buyers will have titles transferred to their name. There is no longer a buyer demand option.
No Retail buyers in state or out of state will be allowed to purchase Dealer only Items! No Exceptions!
Please note: Effective January 1, 2022, our transaction fees structure has been adjusted; Each purchased Lot will be subject to a transaction fee of:
Internet Premium: 16%
Sales Tax : 7.75% - Sales tax applied to Hammer Price.

Payment
Purchases must be paid in full within two(2) days of the end of the auction. Buyers cannot remove their purchases from the auction site until their invoice is paid in full.
Wire Transfer, Certified Cashier's Check, and Cash payments will be accepted.

No cash payments accepted at the auction site.
NO CREDIT OR DEBIT CARD, NO PERSONAL OR COMPANY CHECKS ACCEPTED FOR PAYMENT.
If you make a purchase, DO NOT ARRIVE AT THE AUCTION FACILITY UNTIL YOU HAVE RECEIVED AN EMAIL WITH YOUR INVOICE.
If PRO Auction Company does not receive full payment within three (3) days of the end of the auction, are subject to 18% interest, deposit forfeiture, and a restocking fee up to 25% of your total purchases will be added to your total balance account.
Please note: Failure to pay the total amount due will result in being banned from future auctions and will be reported to Proxibid.
Removal and Shipping
Items must be removed by the Friday after the auction. You are responsible for transporting purchased lots from the auction site to your desired location. At no time will any purchased lot be released to you until payment in full for all lots purchased by you has been received by Pro Auction Company. You agree to compensate Pro Auction Company for any storage, hauling charges or damages suffered by Pro Auction Company because of your failure to remove any purchased lots within the removal period specified by Pro Auction Company for the auction. Bidder acknowledges that the auction site is a dangerous place. Loading and unloading of your items is offered as a courtesy only if time allows and buyer takes full responsibility for any loss or damages.
Notice to the public regarding vehicle purchases:
THERE IS NO COOLING-OFF PERIOD UNLESS YOU OBTAIN A CONTRACT CANCELLATION OPTION. California Law does not provide for a “cooling-off” or other cancellation period for vehicle lease or purchase contracts. Therefore, you cannot later cancel such contract simply because you change your mind, decide the vehicle costs too much, or wish you acquired a different vehicle. After you sign a motor vehicle purchase or lease contract, it may be canceled with the agreement of the seller or lessor or for legal cause, such as fraud. However, California law does require a dealer to offer a 2-day contract cancellation option on used vehicles with a purchase price of less than $40,000, subject to certain statutory conditions. This contract cancellation option requirement does not apply to the sale of a recreational vehicle, a motorcycle, or an off-highway motor vehicle subject to identification under California law. “An on-road heavy-duty diesel or alternative-diesel vehicle operated in California may be subject to the California Air Resources Board Regulation to Reduce Particulate Matter and Criteria Pollutant Emissions from In-Use Heavy-Duty Diesel Vehicles. WHEN OPERATED IN CALIFORNIA ANY OFF ROAD DIESEL VEHICLE MAY BE SUBJECT TO THE CALIFORNIA AIR RESOURCES BOARD IN-USE OFF-ROAD DIESEL VEHICLE REGULATION. IT THEREFORE COULD BE SUBJECT TO RETROFIT OR ACCELERATED TURNOVER REQUIREMENTS TO REDUCE EMISSIONS OF AIR POLLUTANTS.
